Conceptualizing a climate change legislative framework in Qatar based on the capacity of existing environmental legislation: an exploratory and explanatory study

Abstract
This PhD thesis focuses on examining and interpreting various pieces of environmental legislation in order to conceptualize the climate legislation mechanism in Qatar. The main research methodology employed in this study involves doctrinal analysis of environmental legislation and content analysis of national development plans, particularly the environmental pillar. The study utilizes an analysis of the existing environmental legislation as well as the environmental section of national development plans. The analysis includes the consideration of several legal documents such as laws, decree laws, Emiri Decrees, Emiri Resolutions, Decrees, Council of Ministers Resolutions, Prime Minister Resolutions, and Ministerial Resolutions. The main findings of this thesis highlight that while Qatar currently lacks a specific climate change law, there are elements that could be utilized to develop such a law. The study suggests that building a legislative framework for climate change could help avoid the irregular development that has been observed in environmental legislation in Qatar. Thus, this thesis proposes a legislative framework for climate change based on legislative policy and legislative drafting. It also legally codifies the content of the NCCAP, specifically focusing on reducing GHG emissions by 25% by 2030. By aligning with Qatar’s international obligations, such as the Nationally Determined Contributions (NDC) submission to the United Nations Framework Convention on Climate Change (UNFCCC), the proposed legal text becomes more acceptable.
